Terms and conditions of purchase
The following is the contractual document that will govern the purchase of products through the website https://modestacasinello.com/ owned by Mode On Line, S.L. (hereinafter the provider). Acceptance of this document implies that the user:
- Has read, understands and understands what is set forth herein.
- That he/she is a person with sufficient capacity to purchase.
- That he/she assumes all the obligations set forth herein.
The present conditions will have an indefinite period of validity and will be applicable to all contracts made through the website https://modestacasinello.com/. The provider reserves the right to unilaterally modify these conditions, without affecting the products or promotions that were purchased prior to the modification except in case of error.
Identity of the parties
On the one hand, the provider of the goods or services contracted by the user is Mode On Line, S.L., with registered office at C/ Marqués de Larios, 4, Planta 2ª, 29005, Málaga (Spain), with CIF: B19621853 and customer service telephone number 696 96 16 68, and on the other hand, the user, registered on the website as a guest or through a username and password that provides the data on which it has full responsibility for use and custody, being responsible for the accuracy of the personal data provided to the provider.
The conditions described on this page are only for orders placed from the website https://modestacasinello.com/.
The currency used for the payment of the products will only be the euro €. The purchase procedure may be carried out in Spanish or English.

How to buy
The purchase procedure is carried out completely electronically through the website. Any person with Internet access can carry out the purchase, with the only prerequisite of having provided contact and billing information. This requirement is essential in order to start the contracting or purchasing procedure.
If the user is not yet registered, he/she can place an order and also create an account by filling in a form with a series of data to carry out the control, invoicing and shipment of the orders.
The steps of the purchase procedure are visible throughout the entire purchase procedure. The user only has to select the product he/she wishes to purchase and click on the "Add to cart" button. This will start the contracting procedure, which will always follow the steps indicated above.
If the user changes any of the data entered, the summary shown on the screen will change automatically. Likewise, there is also a space specifically enabled for the user to make specific comments regarding their purchase.
In spite of adding a specific product, the user can continue with the purchase, being all the selected products included in the basket until he/she clicks on the button of continuation of the contracting procedure.
Once the purchase is completed, a summary screen of the purchase will be displayed. In case of having selected the payment by credit card, this will be carried out through the TPV of the bank, platform whose security is guaranteed by the financial entity.
This document is the confirmation that the purchase has been made successfully and serves as accreditation for any type of claim, as long as the corresponding proof of payment is attached. If you do not receive this e-mail, please check your "junk mail" or "spam" account, as it may have been detected as spam. If you do not find it in this section, please inform us as soon as possible so that we can solve the problem.
Prices, offers and discounts
The prices indicated for each product will be expressed in Euro currency (€). The prices indicated next to each product include VAT. In another section, before finalizing the purchase, shipping costs are included.
Methods of payment
We have several forms of payment:
- Payment by PayPal.
- Payment by credit card. At no time Modesta Cassinello will collect your card details, we will redirect you to the secure virtual POS of our bank.
- Payment by Bizum.
- Express payment through Google Pay.
- Express payment through Apple Pay.
- Bank transfer. To process your order you have to make a bank transfer to our account number that we will indicate when confirming the order. Delivery time may depend on the payment confirmation.
Delivery of orders and shipping costs
Orders will be delivered to the delivery address freely designated by the user. In the registration process you can indicate a different address to receive your orders.
The shipment of the products purchased will only be made when the user has made full payment and this has been received by the provider. Until that moment the purchase will not be considered completed. The provider informs the customer that there is a possibility that the selected product is not in stock.
The provider assumes no responsibility for when the delivery of the product does not take place as a result of the data provided by the user are false, inaccurate or incomplete or when the delivery can not be made for reasons beyond the provider as is the absence of the recipient.
Notwithstanding the foregoing, we will take the measures required of a diligent merchant so that delivery can be made within the agreed time, and if not, as soon as possible, to the satisfaction of the sender and the recipient, so that no liability can be imputed against the provider.

Case 1: Returns for withdrawal of purchase
All products purchased on this website can be returned and refunded, provided that you indicate your intention to return the product(s) within 7 days of receipt and communication, and that they comply with the other conditions set out below.
Requirements for returns due to withdrawal:
- For the return shipment, the support with which the product was received must be used. In the case of not having this support, the customer must return it well protected.
- The product(s) must be returned in their original box/packaging.
- Products once tested and used will not be returned.
- Sealed items that are not suitable for return for reasons of health protection or hygiene, and that have been unsealed after delivery, will not be returned.
- Loose accessories that are complementary to other main base products will not be accepted.
- Upon receipt of the request for the right of withdrawal, we will proceed to refund the economic amount minus shipping costs (4.95€ per package). This amount will be paid within 14 days by bank transfer.
Steps to follow
Contact us to provide us with all the details of the product, through our e-mail firstname.lastname@example.org to obtain confirmation of the return.
Upon receipt of the products we will proceed to examine them and is when we will inform you whether or not you are entitled to a refund of the amounts paid for the product(s) purchased.
The return process will be carried out within 14 days. The return will be carried out by bank transfer, the data required for the return must be sent by the customer to the email email@example.com.
Case 2: Returns for defective product
In cases where you consider that at the time of delivery of the product does not conform to the same as stipulated in the contract.
Steps to follow
Call our customer service phone number and tell us about the damage caused by transport and/or damage to the product.
Once we receive the product, we will examine it carefully and we will contact you indicating if we accept the return or replacement of the product. The exchange or return will be effective as soon as possible and, in any case, within 14 days from the date on which we send you an e-mail confirming acceptance of the return.
In the event that we do not have stock of such product, we will refund the full amount paid for the product, including delivery costs incurred to deliver the item and the costs that the customer would have had to return the product. Partial returns and/or partial cancellations will result in partial refunds of the amount paid for the order.
Applicable Law and Jurisdiction
These conditions shall be governed by or construed in accordance with Spanish law in that which is not expressly stated. The provider and the user agree to submit any dispute that may arise from the provision of products or services covered by these Conditions, to the Courts and Tribunals where the user is located.
Likewise, the provider and the user may submit their disputes to the arbitration provided for in the legislation on arbitration and consumer and user protection, and to the out-of-court dispute resolution procedures established by means of codes of conduct or other self-regulatory instruments.
